LEGAL RESOURCES

Helpful Resources
for California Accident Victims

Find important information about your rights, deadlines, reporting requirements and motorcycle safety in California. These resources can help you make informed decisions about your next steps.

FREQUENTLY ASKED QUESTIONS

Many California personal injury lawsuits have a two-year filing deadline. Government claims can have much earlier deadlines; exceptions also apply. Ask about the dates that apply to your case.

DMV requires an SR-1 within 10 days when someone is injured or killed, or property damage exceeds $1,000. It is separate from a police or insurance report.

Bring any available accident photos, insurance information, medical records and witness details. You can still call if you do not have everything yet.

Deadlines and requirements can vary based on your specific situation. It’s important to get legal advice about your case.

PURE COMPARATIVE FAULT

Partly at fault? You can still recover.

California reduces your recovery by your share of fault — it doesn't erase it. Drag to see how.

Illustration of the general rule only. Insurers routinely overstate a claimant's share of fault — we negotiate that percentage down or eliminate it.

STATUTE OF LIMITATIONS

Deadlines that matter.

Pick the date of the incident to see the two clocks that usually apply.

Government entities6 months

Written claim within six months (Government Code §911.2) — city vehicles, public buses, dangerous public roads.

Most injury claims2 years

Two years from the injury (Code of Civil Procedure §335.1). Miss it and the court will almost always dismiss the case.

Exceptions run in both directions — discovery rules, minors, continuing violations, out-of-state defendants — so don't assume your deadline has passed, or that you have time to spare.

DAMAGES

We build each category with documentation — medical records, wage statements, expert opinions — so nothing is left on the table.
