Nobody hands you a price list after a crash. Insurance adjusters, however, work from a fairly predictable set of inputs — and once you understand those inputs, the number on a settlement offer stops looking arbitrary and starts looking negotiable.
What a California Car Accident Settlement Actually Pays For
Every settlement is built from two categories of damages. Understanding how car accident settlements work starts with knowing which bucket each dollar comes from.
Economic damages are the losses with receipts attached:
- Past and future medical treatment — ER, imaging, surgery, physical therapy, injections
- Lost wages and lost earning capacity if you can't return to the same work
- Vehicle repair or replacement, rental car, towing
- Out-of-pocket costs such as prescriptions, mileage to appointments, and in-home help
Non-economic damages cover what the receipts don't: physical pain, anxiety and sleep loss, scarring, and the activities you can no longer do. California places no statutory cap on non-economic damages in ordinary auto cases — the caps people have heard about apply to medical malpractice claims, not car crashes.
In rare cases involving egregious conduct — a drunk driver, for example — punitive damages may also be available under California Civil Code § 3294. They are the exception, not the expectation.
How Insurers Put a Number on Your Claim
Adjusters generally start with your verifiable medical specials and build outward. Two informal methods dominate:
- The multiplier method. Total medical bills are multiplied by a factor — often somewhere between 1.5 and 5 — with the multiplier rising as injuries become more objective, more permanent, and better documented.
- The per diem method. A daily dollar value is assigned to the disruption in your life and multiplied by the days from the crash to maximum medical improvement.
Most large carriers also run claims through internal evaluation software that scores your file against past outcomes. Neither approach is law. There is no California statute that says a herniated disc is worth X — which is precisely why documentation and negotiation matter so much.
The Factors That Move the Number Most

- Objective injury findings. MRI results, fractures, and surgical recommendations carry far more weight than pain reported without imaging.
- Treatment gaps. A three-month break between appointments is the single easiest argument an adjuster has for cutting an offer.
- Liability clarity. A rear-end collision with a police report is valued differently than a disputed left-turn intersection crash.
- Available insurance. California's minimum liability limits rose on January 1, 2025 to $30,000 per person / $60,000 per accident / $15,000 property damage. That ceiling — not your injuries — is often the real constraint.
- Permanence. A documented lifelong restriction changes the analysis entirely, which is why catastrophic injury claims are evaluated on a different scale.

- Medical liens and reimbursement claims from health insurers, Medi-Cal, Medicare, or providers who treated you on a lien.
